Mayor Berry Burns Fire Fighters!

Dear Members,
 
Mayor Berry has violated our contract and our collective bargaining rights by unilaterally reducing our wages. We firmly maintain our position that we have never consented in any way to open contract negotiations, request mediation or submit any last best offers. The Labor Management Relations Ordinance (LMRO) is not applicable since our contract is valid through June 2011 and we are not in negotiations. Therefore, how is it that the Mayor has the authority to unilaterally impose pay cuts if we never engaged in contract negotiations?  
 
Since April we, in good faith, have offered numerous concessions that amount to far more than the Mayor needed to avoid pay cuts consistant with City Council's budget. We also offered to defer our raises until there was evidence that the City could afford them. All of our offers were rejected. Instead the Berry Administration wastes money in paying Management Assoc, Inc. to do its bidding. By trying to impose his will only proves that this is not about sound management and balancing the budget, it is about a political and social agenda that has no place in the Mayor’s office. He would rather balance the budget not through sound management, but by taking pay from our families and wasting taxpayer’s money on Management Assoc, Inc. This is a blatant disregard for the value of Fire Fighters in Albuquerque.
 
We filed a law suit for breach of contract on June 24, 2010. The IAFF General Counsel and our Local Counsel will be working together on this issue. We will keep you updated as more information becomes available.
