Interpretation of the Hazardous Duty Officers' Employer-Employee Relations Act

The link below will provide you with IAFF Local 244’s position on the Hazardous Duty Officers' Employer-Employee Relations Act. This bill was introduced last year by the New Mexico Professional Fire Fighters Association with the righteous intent of providing an investigative procedure for all Hazardous Duty Officers in New Mexico to ensure “due process” for serious misconduct/criminal allegations by their employer. The intent of this bill was never to supersede the investigative/disciplinary procedures of any Fire/Police Department. We have received numerous calls in reference to the “Investigative Interrogations of AFD Hazardous Duty Personnel,” Fire Chief’s Executive Directives #41, dated 9/22/10. The Fire Chief has taken this position and we feel it is extreme. We will work on this issue in Labor Management Committee to try and reinstate our previous policy and practice. We have also been in contact with Legislators that have agreed to help amend this act for its appropriate application during the upcoming legislative session.
